FMCSA Hours of Service – HOS.

May not drive after 60/70 hours on duty in 7/8 consecutive days. A driver may restart a 7/8 consecutive day period after taking 34 or more consecutive hours off duty as per 2013 FMCSA hours of service HOS rules.

Commercial Motor Vehicle (CMV) drivers using a sleeper berth must take 10 hours off duty, but may split sleeper-berth time into two periods provided neither is less than 2 hours.

CMV drivers using the sleeper berth provision must take at least 8 consecutive hours in the sleeper berth, plus 2 consecutive hours either in the sleeper berth, off duty, or any combination of the two.

Passenger-carrying carriers/drivers are not subject to the new hours-of-service rules. These operations must continue to comply with the FMCSA hours of service HOS rules limitations specified in 49 CFR 395.

SIMPLY stated the new rule means:

Drivers may drive up to 11 hours in the 14-hour on-duty window after they come on duty following 10 or more consecutive hours off duty.
The 14-hour on-duty window may not be extended with off-duty time for meal and fuel stops, etc.
The prohibition on driving after being on duty 60 hours in 7 consecutive days, or 70 hours in 8 consecutive days, remains the same, but drivers can “restart” the 7/8 day period anytime a driver has 34 consecutive hours off duty.
CMV drivers using the sleeper berth provision must take at least 8 consecutive hours in the sleeper berth, plus 2 consecutive hours either in the sleeper berth, off duty, or any combination of the two.

Short-Haul Provision:

Drivers of property-carrying CMVs which do not require a Commercial Driver’s License for operation and who operate within a 150 air-mile radius of their normal work reporting location:

May drive a maximum of 11 hours after coming on duty following 10 or more consecutive hours off duty.
Are not required to keep records-of-duty status (RODS).
May not drive after the 14th hour after coming on duty 5 days a week or after the 16th hour after coming on duty 2 days a week.

Employer must:

Maintain and retain accurate time records for a period of 6 months showing the time the duty period began, ended, and total hours on duty each day in place of RODS.
Drivers who use the above-described Short-haul provision are not eligible to use 100 Air-mile provision 395.1(e) or the current 16-hour exception in 395.1 (o).

In developing these hours-of-service regulations, the Federal Motor Carrier Safety Administration (FMCSA) systematically and extensively researched both United States and international health and fatigue studies and consulted with Federal safety and health experts. Our roads are better designed, constructed, and maintained in a nationwide network to provide greater mobility, accessibility, and safety for all highway users. Vehicles have been dramatically improved in terms of design, construction, safety, comfort, efficiency, emissions, technology, and ergonomics. These factors, combined with years of driver fatigue and sleep disorder research, led to a revision of the hours-of-service regulations for drivers.

FMCSA will continue working with its partners and stakeholders to assure a smooth transition to the new regulations. Legal Loads:
Length: There is currently “no set maximum” for vehicles. Trailer length maximum is 53’.
Width: 8’ 6” wide.
Height: 13’ 6” tall.
Weight: 80,000 lbs. GVW, 20,000 single, 34,000 tandem.
Overhang: 3′ in the rear and 6′ in the front.

Routine over-weight, oversize shipping, trucking and transport permits:
Length: Since STATE NAME has no said length restrictions you overall length approval will depend on your proposed route.
Width: 16′ on four lanes roads and highways and 15′ on two lane roads and highways.
Height: 15′ is about the most you can get away with on routine permits and main routes. Anything taller than that off of the main roads should prepare to have a route survey performed.
Weight: STATE NAME is somewhat difficult in weight determination. If you are over 120,000 lbs or have any extremely heavy axle groupings you will be considered a super-load. All applications for permits will a computer analysis done with anything that fails being then evaluated by the district bridge supervisor for further review. If you are under 100,000 pounds and main road routing proposed you will probably get permitted routinely. Remember this however; anything for any amount of time can happen in this state when extreme weights are considered.
Overhang: It doesn’t get much better than this; 30′ rear and 15′ front for overhang.

Travel times and restrictions:
No weekend travel is permitted in STATE. You can request to travel on the weekend when you are applying for your permit however. They have been known to grant weekend travel to loads that are say 14′ in width or a little on the heavy side but do not count on approval. Travel is not permitted on the following holidays: New Years day, Good Friday, Memorial day, Independence day, Labor day, Thanksgiving day and Christmas day. The permit office is also closed on these days as well.

Pilot Car and Escort vehicle information:
Length: If load is 75′ to 95′ on a 2 load road you will need one rear pilot car (escort).
Width: 10′ 6″ to 12′ wide on a 2 lane road requires 1 front pilot car. On a 4 lane road up to 12′ wide requires no escorts. When load is 12′ 1″ to 14′ wide 1 front and 1 rear pilot car (escort) is required on all 2 lane roads and 1 rear on all 4 lane roads. For loads 14′ 1″ – 15′ wide 1 front and 1 rear pilot car (escort) is required. 15′ 1″ to 16′ wide on 2 lane requires 2 front pilot cars (escorts) and 1 rear pilot car (escort). On 4 all lane roads 1 front and 2 rear pilot cars (escorts) are required. If you do have a permit for weekend travel you will be required to have a police escort. Districts and Parkways may require additional escorts as well. Vehicles traveling with a width of over 14′ wide will not be allowed to travel on Fridays except on Parkway. Maximum width allowed on the Parkway is 16′ and must be accompanied by police escort if over 15′.
Height: If height of load exceeds 15′ a front high pole card is required.
Weight: Check with the State of to see if your weight class will require a pilot car/escort.
Overhang: If front over hang is over 10′ on 2 or 4 lane roads 1 front pilot car (escort) is required. If rear overhang exceeds 10′ on a 2 or 4 lane road one rear escort is required.

Pilot car and escort vehicle requirements:
All pilot cars/escort vehicles must display a bumper or roof mounted “OVERSIZE LOAD” sign visible from both the front and rear of the vehicle. Sign must be at least 5′ long and 12″ in height, yellow in color with black letters no less than 10″ tall and 1 1/2″ in width. Vehicle must have 2 safety flags red or orange in color and be a minimum of 18″ of length and/or height mounted at a 40 to 70 degree angle on all 4 corners of the vehicle. Company identification signs must be placed on both sides of the pilot car (escort vehicle) displaying the name of the company, phone number and be placed on both the left and right hand sides of the vehicle. These signs must be no less that 8″ tall x 12″ wide and identity writing must be plainly legible. Vehicle must be equipped with a horizontally mounted rotating (or strobe) amber colored flashing light which must be visible from a 360 degree angle from a minimum of 500 feet. Vehicles must be equipped with a CB radio or 2-way communication device, 2 – 5 pound fire extinguishers type A, B and C, a sign with the word “STOP” on one side and “SLOW” on the other with dimensions of no less than 18″ in diameter with a minimum of 6″ letters. A red safety colored flag with handle no less than 18″ square, 3 reflective emergency road triangles or 18″ traffic cones, 2 OVERSIZE LOAD banners (yellow with black lettering) and a safety colored (red, orange, yellow or lime green) vest, jacket or shirt (used while directing traffic).

For a vehicle to qualify; all pilot car/escort vehicles must have a gross weight over over 2,000 pounds but also have a manufacturers gross weight rating of less than 26,000 pounds.

Frost laws.  In States and Providences in the USA and Canada that experience very low temperatures in the winter months frost laws have been enacted.  These frost laws have been created to protect the State of Providences from highway and road damage caused by the surface cracking which is a direct result of too much weight being placed on the pavement which causes stress cracks thus damaging it.  Also, when the freezing temperatures start to thaw out at times the water can not escape quickly which will cause the water to build up which can weaken the base structure of the road or highway which again causes damages the the pavement.  Damages from thawing are just as severe if not even more extreme than frozen damages as they occur to the upper structure of the pavement rather than the base structure.  In some areas during the winter months actual federal weight limits for the trucking industry (80,000 pounds gross) have been reduced with a reduction in driving speeds as well.  This reduction has been observed as high as 35% in weight and even more in maximum speeds.  Some States and Providences close winter and spring travel in certain areas.

It is very important that managers of trucking and transportation companies are aware of the open and closed months, days and times these particular laws are in effect as you can’t make an arrangement with a customer to ship their item if the state will not let you ship it due to frost or thaw laws being in effect.  We are creating  a contact list (EDIT ADD LINK)  of each state that has frost laws enacted for the trucking industry for you to contact for further information.

Weight: Yukon Territory allows for 29,700 lbs on a single axle, 50, 600 lbs on a tandem axle and 63,800 lbs on a tridem axle.
Overhang:  Route specific as determined in overall length above.

Notes:  Anything over the above is more than likely is a superload.  Here is the latest superload information.  Lights, flags and signs: Lights are required in positions of flags at night.  Flags are to be positioned on all 4 corners of outer most extreme corners.  Signs should read “WIDELOAD” for wide loads and “LONG LOAD” for long loads.  Loads that are both wide and long you should have OVERSIZE LOAD” banners but a “WIDELOAD” banner may be used.

FROST & THAW LAW RESTRICTIONS: Yukon Territory does have spring weight restrictions and the roads and highways are dependent on conditions.  Overall weight reductions may be imposed up to 50% reductions have been noted.  Check with Yukon Territory permit office for clarification.

Travel times and restrictions:
Travel is permitted 24/7 with the following imposed maximums in Yukon Territory;  10′ 6″ in width, 14′ 6″ in height, 82′ in length.  If load exceeds these dimension daylight only travel is permitted.  No travel on Sunday is permitted, and no travel during the summer months (last Friday in June until the second Monday and September) after 2 pm.  On Fridays and Saturdays you may resume travel at 4 am the following morning.  Holiday restrictions vary so refer you your permit or or contact the Yukon Territory permit office for clarification.

Pilot Car and Escort vehicle information:
Length: If load is over 85′ 5″ long you need one rear pilot car (escort), over 101′ 9″ long requires 1 front and 1 rear pilot car (escort).
Width: If over 10′ 5″ wide 1 rear pilot car (escort) vehicle is required (beacon light may be substituted if not on highway 97).  Over 11′ 5″ requires one rear pilot car (escort), over 12′ 6” requires 1 front and 1 rear pilot car (escort).
Height: If t all depends on your route.  Height in case by case basis for pilot cars (escort).
Weight: Check with Yukon Territory DOT to see if your weight class will require a pilot car/escort.
Overhang: If over 21′  4″ past the last axle in overhang you are required to have one rear pilot car (escort vehicle).

Pilot car and escort vehicle requirements:
All pilot cars/escort vehicles must display a bumper or roof mounted “OVERSIZE LOAD” sign visible from both the front and rear of the vehicle. Sign must be at least 5′ long and 12″ in height, yellow in color with black letters no less than 10″ tall and 1 1/2″ in width. Vehicle must have 2 safety flags red or orange in color and be a minimum of 18″ of length and/or height mounted at a 40 to 70 degree angle on all 4 corners of the vehicle. Company identification signs must be placed on both sides of the pilot car (escort vehicle) displaying the name of the company, phone number and be placed on both the left and right hand sides of the vehicle. These signs must be no less that 8″ tall x 12″ wide and identity writing must be plainly legible. Vehicle must be equipped with a horizontally mounted rotating (or strobe) amber colored flashing light which must be visible from a 360 degree angle from a minimum of 500 feet. Vehicles must be equipped with a CB radio or 2-way communication device, 2 – 5 pound fire extinguishers type A, B and C, a sign with the word “STOP” on one side and “SLOW” on the other with dimensions of no less than 18″ in diameter with a minimum of 6″ letters. A red safety colored flag with handle no less than 18″ square, 3 reflective emergency road triangles or 18″ traffic cones, 2 “OVERSIZE LOAD” banners (yellow with black lettering) and a safety colored (red, orange, yellow or lime green) vest, jacket or shirt (used while directing traffic).
